1. Acceptance of terms

By creating an account, submitting a scan, or otherwise using tokiGig, tokiScan, tokiOS, or any related service (collectively, the "Service"), you agree to these Terms and Conditions and our Privacy Policy.

You must be at least 18 years old or have the legal authority to bind a business entity to these terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

We may update these terms from time to time. Material changes will be communicated via email or in-product notice at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.

2. Description of service

tokiGig LLC provides AI visibility tools for businesses, including:

• tokiScan — an AI Trust Report tool that crawls publicly accessible pages of a submitted website and returns an AI Trust Score and recommendations.
• tokiScan Monitoring — an automated recurring scan service that tracks your AI visibility score over time and alerts you to changes.
• tokiOS — an AI-powered operating system for autonomous business workflows.

Scan results and AI Trust Scores are informational estimates based on publicly available signals. They are not a guarantee that your business will be recommended by any AI system, search engine, or third-party platform. Results may vary based on factors outside our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and access

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@tokigig.com if you suspect unauthorized access.

One account per person or business entity unless otherwise agreed in writing. You may not share accounts or credentials.

We may suspend or terminate accounts that violate these terms, engage in abuse, or fail to maintain payment in good standing.

4. Payments and billing

Founding access

Customers who purchase at Founder Pricing receive access to tokiScan at a discounted rate as recognition of their early support. Founding Access includes:

• 12 months of full tokiScan access at Founder Pricing
• After 12 months, automatic conversion to a permanent Founder Discount on the then-current subscription pricing — for life
• A permanent Founding Member badge in the product
• Priority support access

You will receive email notification at least 30 days before any conversion from Founder Pricing to a subscription tier. You may cancel before conversion if you choose not to continue.

Subscriptions

Paid subscription tiers are billed monthly or annually at the rates displayed at checkout. Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

Annual subscriptions are billed upfront for the full year. Cancellation mid-year results in prorated credits, not cash refunds (except within the refund window described below).

tokiScan monitoring add-on

tokiScan Monitoring is available as a standalone add-on or as part of a bundle. Monitoring fees are billed as part of your subscription cycle. Automated scans run on a schedule defined by your plan. Historical monitoring data is retained for the duration of your active subscription and for 30 days after cancellation.

Payment processing

All payments are processed by Stripe. tokiGig does not store or have access to your payment card data. By completing a purchase you also agree to Stripe's Terms of Service.

Failed payments

If a payment fails, we will attempt to notify you and retry. Access may be suspended after repeated failed attempts. You are responsible for keeping your payment method current.

5. Refund policy

7-day refund window: New subscribers and Founding Access purchasers may request a full refund within 7 days of purchase, no questions asked. Contact legal@tokigig.com to request a refund.

After 7 days: No cash refunds. Downgrading a subscription results in prorated credits applied to your next billing cycle.

Usage-based and monitoring fees: Fees for scans already consumed or monitoring cycles already run are non-refundable.

Annual subscriptions: Refundable in full within 7 days of purchase. After 7 days, prorated credits only — no cash refunds.

We reserve the right to decline refund requests where we have evidence of abuse or policy violations.

6. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not:

• Submit URLs for scanning that you do not own or do not have explicit permission to scan
• Use the Service to scrape, harvest, or collect data about third parties without authorization
• Attempt to reverse-engineer, decompile, or extract the scoring model or proprietary algorithms
• Use automated tools to abuse, overload, or circumvent rate limits on the Service
• Use the Service for any illegal purpose or in a way that harms third parties
• Resell or sublicense access to the Service without written authorization from tokiGig

Violations may result in immediate account suspension or termination without refund.

7. Intellectual property

tokiGig LLC owns all rights to the Service, including the brand, product design, software, scoring models, algorithms, and content we create. Nothing in these terms transfers any ownership to you.

Your scan results and report data belong to you. We do not claim ownership of data derived from your website.

By submitting a URL for scanning, you grant tokiGig a limited, non-exclusive license to crawl and process publicly accessible content on that URL solely for the purpose of generating your AI Trust Report. This license does not extend to storing, publishing, or redistributing your site content.

11. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these terms or the Service shall be resolved in the state or federal courts located in Travis County, Texas. You consent to the exclusive jurisdiction of those courts.

For international users: if you are located in the European Union or other jurisdictions with mandatory consumer protection laws, those local laws may apply in addition to these terms.

12. Termination

You may cancel your account at any time by contacting legal@tokigig.com or through your account settings. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or present a risk to other users or the platform.

On termination, your access to the Service ends. Your data is retained and handled per our Privacy Policy. Monitoring data is retained for 30 days after cancellation then deleted.

Sections 7, 8, 9, 10, and 11 survive termination.
